AMENDED ORDER OF THE REGISTRAR, MARK BEER
UPON the Petition of Royal Investment Bank Limited;
AND UPON hearing Counsel for the Petitioner;
AND UPON reviewing DIFC Insolvency Law No. 3 of 2009 (“the Insolvency Law”);
AND UPON amending the typographic error in paragraph 3 of the order of 22 November 2012;
IT IS HEREBY ORDERED THAT
1. The Petitioner shall arrange for an advertisement to be placed in an English and an Arabic language newspaper (as required by Practice Direction No. 3 of 2011) in substantially the form of the attached Schedule.
2. Any objections to the winding up of Bridgehead Administration Limited or the appointment of Shahab Haider as Liquidator be filed with the
DIFC Courts within 7 business days after the date of the advertisement, and any such objections are to be listed for hearing on a date to be fixed by the
Registry.
3. In the event that no objections to the winding up order are received by the DIFC Courts within 7 business days after the date of the advertisement (see paragraph 2 above), the Order in paragraph 4 shall take automatic effect.
4. Subject to paragraph 3 above:
a) Bridgehead Administration Limited be wound up pursuant to Article 50(b) of the Insolvency Law;
b) Mr Shahab Haider be appointed
Official Liquidator pursuant to Article 58 of the Insolvency Law, Regulation 5.4.2 of the Insolvency Regulations and RDC
54.88;
c) The Petitioner shall be entitled to its costs of the Petition to be summarily assessed by the
Registrar.
