IT IS ORDERED THAT
1. Parties to file and exchange written submissions on the permissibility of Claimants' Additional Requests for Information dated 11 February 2013 ("ARFIs") by no later than 26 February 2013.
2. Parties to file and exchange their reply to the other party's written submission in relation to ARFIs as directed at paragraph one above by no later than 5 March 2013.
3. Defendant to file any application with respect to the Claimants' Reply to Defence by no later than 28 February 2013.
Production of Documents
4. Each party to make standard disclosure by documents to the other party, pursuant to RDC
28.6 by
26 February 2013 (
"Standard Disclosure").
5. Any Request by a party pursuant to RDC
28.13 for specific production of documents is to be filed and served by
21 March 2013 (
"Request to Produce").
6. Documents responsive to a Request to Produce or objections thereto pursuant to RDC
28.16 and
28.42, are to be served by
28 March 2013.
7. Any application by a party for specific disclosure pursuant to a Request to Produce is to be filed by 11 April 2013 ("Specific Disclosure Application").
8. Evidence in response to Specific Disclosure Application to be filed by 18 April 2013.
9. Any responsive evidence in the Specific Disclosure Application to be filed by 25 April 2013.
Hearing
10. The hearing of any applications to be listed for hearing by no later than 2 May 2013 with one day time estimate.
Witness Statements of Fact
11. Witness Statements of Fact upon which the parties seek to rely are to be exchanged by 16 June 2013.
12. Supplementary Witness Statements of fact responsive to the statements at paragraph nine to be exchanged by no later than 14 July 2013.
Expert Reports
13. Claimants' Expert Surveyor Reports to be served by no later than 28 July 2013.
14. Defendant's Expert Surveyor Report to be served by no later than 12 September 2013.
15. Parties' experts to meet by no later than 26 September 2013 and to file Supplemental Report listing areas of agreement and disagreement by 3 October 2013.
Pre-Trial Review
16. A Pre-Trial Review is to be fixed for 20 October 2013.
Trial
17. Trial is to be listed for 17 November 2013 with a 5 day time estimate.
