UPON the parties having agreed to vary the terms of the Case Management Conference Order dated 5 September 2019 (the “CMC Order”) by a Consent Order dated 2 April 2020 (the “Consent Order”)
AND UPON the parties having agreed to vary the terms of Consent Order as set out below
AND UPON reading the Court file
AND UPON reviewing the Rules of the DIFC Courts (the “RDC”)
IT IS HEREBY ORDERED BY CONSENT THAT:
1. Paragraph 1 of the Consent Order be varied to provide that the parties shall file and exchange signed statements of witnesses of fact, and hearsay notices by no later than 4pm on Thursday, 14 May 2020.
2. Paragraph 2 of the Consent Order be varied to provide that any Witness Statement in reply shall be exchanged by no later than 4pm on Thursday, 4 June 2020.
3. Paragraph 3 of the Consent Order shall be varied to provide that Expert Reports shall be filed and served by no later than 4pm on Thursday, 25 June 2020.
4. Paragraph 4 of the Consent Order shall be varied to provide that Supplemental Expert Reports shall be filed and served by no later than 4pm on Thursday, 9 July 2020.
5. Costs in the case.
6. Liberty to apply.
