UPON the Consent Order dated 5 July 2023 imposing a stay upon these proceedings to allow time for the parties to enter into a mediation process in respect of the dispute (the “Consent Order”) (the “Stay”)
AND UPON reviewing the Claimant’s correspondence with the Registry dated 9 January 2024 confirming that the mediation process has completed and the dispute has not been resolved
AND PURSUANT TO Rule 4.12 of the Rules of the DIFC Courts
IT IS HEREBY ORDERED THAT:
1. The Stay shall be lifted.
2. Pursuant to paragraph 2(a) of the Consent Order, the Defendant shall file and serve its Defence by no later than 16 February 2024.
