UPON reviewing the Claimant’s Application dated 17 January 2018 (“the Application”) seeking an extension of time until 21 January 2018 to file witness evidence in reply to the Defendant’s application to contest jurisdiction filed 26 December 2017;
UPON reviewing the correspondence between the parties annexed to the Application;
UPON receiving the Defendant’s response to the Application on 21 January 2018;
AND UPON reading the relevant material in the case file;
IT IS HEREBY ORDERED BY THAT:
1.The Claimant’s Application is refused.
2. The deemed filing deadline shall be 17 January 2018.
3. The Claimant shall incur penalty fees of USD200 per day pursuant to Article III (A) (1) of the DIFC Courts Practice Direction No. 3 of 2017, for each day or part day that passes from and including 22 January 2018 until such time as its evidence is filed.
4. The Registry shall liaise with the parties to make directions on consequential case management matters, including an updated case timetable in light of late filing of evidence.
5. No order as to costs.
