CONSENT ORDER
UPON the hearing of the First and Third Defendants’ Application No. CFI-041-2021/10 dated 3 May 2024 (the “Application”) and the Case Management Conference (“CMC”) being listed to take place remotely before Chief Justice Wayne Martin on Monday 4 November 2024 and Tuesday 5 November 2024 (the “Hearing”)
AND UPON the Claimants filing and serving an initial version of the bundle for the Hearing via the Dubai International Financial Centre Courts (the “DIFC Courts”) portal on 28 October 2024
AND UPON the parties agreeing to instruct Opus 2 International Limited (“Opus 2”) to transcribe the Hearing pursuant to Part 35.99 of the Rules of the Dubai International Financial Centre Courts 2014 (“RDC”) and Practical Guidance Note No. 1 of 2023 – Virtual Hearing and Bundling Protocol (“PGN 1/2023”)
AND UPON the parties having agreed to the terms of this order in writing
IT IS HEREBY ORDERED BY CONSENT THAT:
1. The Claimants submit an updated version of the bundle by 11.30pm (GST) on 30 October 2024, containing:
a. The draft Directions Order;
b. The authorities referred to in the parties’ Skeleton Arguments relating to the Application;
c. The parties’ Skeleton Arguments relating to the CMC; and
d. The authorities referred to in the parties’ Skeleton Arguments relating to the CMC.
2. The Claimants submit a third and complete version of the bundle by 11.30pm (GST) on 1 November 2024, containing:
a. The parties’ Statement of Costs in respect of the Application; and
b. Any further correspondence between the parties since 24 October 2024.
3. Opus 2 be permitted to transcribe the Hearing.
4. Costs shall be costs in the case.
