CONSENT ORDER
UPON reviewing the Claimant's Application No. CFl-043-2020/10 dated 7 January 2022
AND UPON the First and the Fourth Defendant’s consent to the amendment of the claim form and particulars of claim in these proceedings in accordance with RDC 18.2(1)
IT IS HEREBY ORDERED BY CONSENT THAT:
1. The First and the Fourth Defendants do not object to the Claimant’s proposed amendments to the Claim Form and Particulars of Claim as filed under the document entitled “Exhibits” at pages 64 to 131 thereof.
2. On the basis of paragraph 1, above, any requirement for permission to be sought from the Court, pursuant to the DIFC Court Rules (“RDC”), for amendments to the Claim Form is dispensed with.
3. The Claimant shall file and serve an Amended Particulars of Claim and Claim Form within 3 days from the date of this order.
4. The First and the Fourth Defendants may file and serve an Amended Defence with Counterclaim within 28 days from the date of service of the Claimant’s Amended Claim Form and Particulars of Claim.
5. The Claimant may file and serve an Amended Reply and Defence to Counter Claim within 21 days thereafter.
6. The Claimant has fulfilled all of its obligations which may fall due under RDC r.18.27 by making payment:
(a) on 27 October 2021, to the First Defendant; and
(b) on 14 December 2021, to the Fourth Defendant,
for the First and Fourth Defendants’ costs associated with the Claimant’s amendments to its Claim Form from the date of filing until the date of amendment.
