CONSENT ORDER
UPON the Case Management Order of H.E. Justice Maha Al Mheiri dated 9 September 2022 (the “CMO”)
AND UPON the amendments made to the CMO by the Consent Order issued by the Acting Registrar Ayesha Bin Kalban dated 28 September 2022
AND UPON the amendments made to the CMO by the Consent Order issued by the Acting Registrar Ayesha Bin Kalban dated 21 October 2022
AND UPON the amendments made to the CMO by the Consent Order issued by the Assistant Registrar Delvin Sumo dated 23 December 2022
AND UPON the amendments made to the CMO by the Consent Order issued by the Assistant Registrar Delvin Sumo dated 26 January 2023
AND UPON the amendments made to the CMO by the Consent Order issued by the Assistant Registrar Delvin Sumo dated 24 March 2023
AND UPON the amendments made to the CMO by the Consent Order issued by the Assistant Registrar Delvin Sumo dated 26 April 2023
AND UPON the amendments made to the CMO by the directions of Saeed Al Dahmani in email correspondence dated 1 June 2023
AND UPON the amendments made to the CMO by the Consent Order issued by the Assistant Registrar Hayley Norton dated 2 June 2023
AND UPON reviewing email correspondence to the DIFC Courts Registry from the parties’ legal representatives with respect to the terms set out in this Order
AND UPON the parties having agreed to the terms set out in this Order
IT IS HEREBY ORDERED BY CONSENT THAT:
1. Paragraph 14 of the CMO shall be amended to read as follows:
“Signed statement of witnesses of fact, and hearsay notices where required by the RDC shall be exchanged by way of mutual exchange by no later than 4pm on 2 November 2023.”
2. Paragraph 15 of the CMO shall be amended to read as follows:
“Any Witness Statement evidence in reply shall be filed and served by no later than 4pm on 30 November 2023.”
3. Paragraph 19 of the CMO shall be amended to read as follows:
“An agreed reading list for trial approved by all parties’ legal representatives, together with an estimated timetable for trial, is to be lodged with the Registry by not later than 1pm on 13 February 2024, together with an estimate of time required for reading.”
4. Paragraph 21 of the CMO shall be amended to read as follows:
“Parties to prepare a Chronology of significant events cross-referenced to significant documents, pleadings and witness statements, to be agreed insofar possible, and to be filed with the Court by not later than 1pm on 13 February 2024. In the event that there are areas of disagreement, the Chronology shall include an agreed Chronology 3 of 3 and a Chronology of events which are disputed, with the parties’ respective positions outlined therein.”
5. All other deadlines shall remain as ordered in the CMO, or as amended by the Consent Orders dated 28 September 2022, 21 October 2022, 23 December 2022, 26 January 2023, 24 March 2023, 26 April 2023, 1 June 2023 and 2 June 2023.
6. Costs of this consent order shall be costs in the case.
7. The parties shall have liberty to apply.
