UPON the Order of the Court of Appeal dated 5 September 2018 issued in the case CA-008-2018 (the “Previous Order”) which provides (among other things) that the Claimant shall file an application to amend the Particulars of Claim by 4pm on 3 October 2018 and for the Claimant to pay the Defendant costs of the appeal of the immediate judgment/strike out application (CA-008-2018) on the standard basis
AND UPON the Notice of Discontinuance filed by the Claimant on 8 October 2018
AND UPON the parties having agreed terms of settlement
IT IS HEREBY ORDERED BY CONSENT THAT:
1. This action be dismissed.
2. The Previous Order be discharged and the Claimant and Defendant be released of their obligations with respect of that order.
3. Each party shall bear its own costs.
