UPON the Claimant’s Application No. CFI-047-2020/10 dated 2 May 2024 pursuant to Rule 4.2(14) and/or Rule 25.1(3)(b) and/or Rule 28.38 of the Rules of the DIFC Courts seeking an order that the Fifth Defendant produce original documents bearing his undisputed signature (the “Application”)
AND UPON considering the written submissions from the Claimant and from the Fifth Defendant
AND UPON the Claimant undertaking to use reasonable care to protect the documents produced by the Fifth Defendant against loss and damage and to return them promptly to him following inspection of the documents by the Claimant’s expert
IT IS HEREBY ORDERED THAT:
1. The Fifth Defendant shall by 3 July 2024 produce to the Claimant the originals of no fewer than 15 documents bearing his undisputed signature from the list of documents set out in Appendix 1 of this Order.
2. The costs of the Application shall be costs in the case.
