UPON the Rules of the DIFC Courts (“RDC”)
AND UPON considering the set aside Application No. CFI-054-2018/21, filed by the First and Second Defendants (the “Defendants”) on 20 January 2022 (the “Set Aside Application”)
AND UPON considering the Permission to Appeal Notice (the “Permission Application”) filed by the Defendants on 19 January 2022
AND UPON hearing counsel for the Claimant and counsel for the Defendants at the directions’ hearing held before the Registrar Nour Hineidi on 31 March 2022 (the “Hearing”)
AND UPON reading the case file, and in particular, the list of issues and e-Bundle agreed by the parties and circulated to the Registry ahead of the Hearing
AND UPON consultation with Justice Lord Angus Glennie, being the Judge assigned to hear the Set Aside Application and the Permission Application on whether he wishes to determine the Permission Application at a hearing or on the papers
IT IS HEREBY ORDERED THAT:
1. The Set Aside Application and the Permission Application shall be heard together at a hearing (the “Joint Hearing”).
2. The Joint Hearing shall be listed for 11am GST on 28 April 2022.
3. Skeleton arguments and an agreed e-Bundle shall be filed and served by 4pm on 25 April 2022. Given that both, the Set Aside Application and Permission Application are filed by the Defendants, it will be the Defendants’ responsibility to take charge of and upload the agreed e-Bundle.
4. Costs of the hearing are costs in the Set Aside Application.
