PURSUANT TO THE Case Management Conference Order of Justice Sir Richard Field issued on 18 March 2020

UPON reviewing the Third Defendant’s Request for Document Disclosure dated 11 June 2020 (the “Third Defendant’s Request”) pursuant to Rule 28.16 of the Rules of the DIFC Courts, and the Claimant failing to file its objections to the Request

AND UPON reviewing the Claimant’s Request for Document Disclosure dated 11 June 2020 (“the “Claimant’s Request”)

AND UPON the Third Defendant filing objections to the Claimant’s Request to Produce on 18 June 2020

IT IS HEREBY ORDERED THAT:

1. Pursuant to the Third Defendant’s Request:

a) The Claimant shall produce Requests No. 2, 4, 5 and 7 in the Third Defendant’s Redfern schedule by no later than 3pm on Tuesday, 14 July 2020.

b) The Third Defendant’s Requests 1 and 3 are denied on the basis that the Request is not limited in time, it does not relate to a narrowly defined category of documents.

2. Pursuant to the Claimant’s Request:

a) Request No. 1 is accepted on the basis the invoices and bills are submitted in a redacted form to show the communication with Mr Magnusson only. These shall be produced by no later than 3pm on Tuesday, 14 July 2020.

b) The Defendants shall produce Request No. 2, 3, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14,15, 16, 17, 18, 19, 20, 22, 23 and 24 in the Claimant’s Redfern schedule. These shall be produced by no later than 3pm on Tuesday, 14 July 2020.

c) The Claimant’s Request No. 4 and 21 is denied.

3. Liberty to apply.

4. Costs in the case.
