UPON the Order of H.E. Justice Maha Al Mehairi on 17 June 2021 that Bird & Bird (MEA) LLP has ceased to be the legal representative of the Third Defendant in the proceedings and that Bird & Bird (MEA) LLP shall provide to the Registry, by 3pm on Monday, 21 June 2021, contact details belonging to the Third Defendant.
UPON the failure of the Third Defendant to provide a new address for service, as required by RDC 37.17.
AND UPON the without notice application of the Claimant/Applicant by its Application Notice dated 24 June 2021 requesting permission, pursuant to RDC 9.31, to serve all future documents in these proceedings on the Third Defendant by email to the email address elitehold@yahoo.com
IT IS HEREBY ORDERED:
1. Pursuant to RDC 9.31, the Claimant is permitted to serve this Order, together with the application notice and supporting evidence, and all future orders or documents in these proceedings on the Third Defendant by email to the email address elitehold@yahoo.com.
2. The Claimant’s document entitled “Submissions on Further Evidence from the First and Second Defendants” dated 23 June 2021 is deemed to have been served on the Third Defendant, via email dated 23 June 2021 (timed 14:47), by the Claimant’s legal representatives, Clyde & Co LLP, to the email address elitehold@yahoo.com.
3. Any party affected by this Order has the right to make an application to set aside or vary this Order, under RDC 23.94, within 14 days from the date of this Order.
