UPON the Claimant’s Notice of Commencement of Assessment of Bill of Costs dated 12 December 2022 (the “NOC”)
AND UPON the Claimant’s Certificate of Service dated 9 January 2023
AND UPON the Claimant filing a request for a Default Costs Certificate dated 4 January 2023 (the “Request”) pursuant to Rule 40.17 of the Rules of the DIFC Courts (the “RDC”)
AND UPON the Defendant’s failure to file its Points of Dispute, pursuant to RDC 40.15, within 21 days from the date of service of the NOC
AND UPON reviewing all other relevant documents filed and recorded on the court file
IT IS HEREBY ORDERED THAT:
1. The Request is granted.
2. The Defendant is ordered to pay the Claimant a total amount of USD 68,521.48 (the “Amount”) within 21 days from the date of this Order, comprising:
(a) USD 63,313, being the amount set out in the Claimant’s NOC;
(b) USD 5,048.48 being the Courts’ filing fees for the NOC and the Request; and
(c) USD 160 in costs payable to the Claimant for the commencement of detailed assessment proceedings, pursuant to RDC 40.22.
3. In the event the Defendant fails to pay the Amount within 21 days from the date of this Order, interest, pursuant to Practice Direction No. 4 of 2017 (Interest on Judgments), will accrue on the Amount from the date of this Order until the date of full payment.
