UPON reviewing the Claimant’s Application Notice CFI-055-2018/3 dated 30 July 2019 seeking a Court Order to amend the Re-Amended Claim Form to the form of the draft Re-Re-Amended Claim Form filed with the Application and rely on the Particulars of Claim filed with the Application in support of that claim (“the Application”)
AND UPON reviewing the parties’ submissions in relation to the Application
AND UPON reviewing the Court file
IT IS HEREBY ORDERED THAT:
1. The Claimant has permission to amend its claim to the form set out in the draft Re-Re-Amended Claim form and to rely upon the Particulars of Claim in support of that claim.
2. The Claimant shall file and serve the said statements of case by no later than 4pm on Wednesday, 18 September 2019.
3. The Defendants shall file and serve consequential amendments to their Defence (if any) by no later than 4pm on Wednesday, 2 October 2019.
4. The Claimant shall file and serve consequential amendments to their Reply (if any) by no later than 4pm on Wednesday, 16 October 2019.
5. Costs of this application are costs in the case.
