UPON the Case Management Order issued on 9 March 2021
UPON reviewing the Defendant’s Application Notice CFI-060-2019/6 dated 22 June 2021 (the “Application”) seeking an extension of time to appoint a new legal representative for the ongoing proceedings in this case
AND UPON the Order of H.E Justice Maha Al Mheiri dated 6 June 2021 declaring Addleshaw Goddard (Middle East) LLP has ceased to act as the Claimant’s legal representative
AND UPON the Court exercising its general case management powers, particularly those powers set out rule 4.2 and rule 4.12 of the Rules of the DIFC Court
IT IS HEREBY ORDERED THAT:
1. The Application is granted.
2. The procedural timetable in this case is stayed for a period of 10 days until 4pm on Thursday, 8 July 2021 (the “Deadline”) in order to allow the Defendant to retain a new legal representative.
3. The Defendant should write to the Court and to the Claimant before the Deadline with an update on when it expects to be in a position to file and serve its witness statements of fact, falling due pursuant to the case management order made in this matter. In the event an extension of time is required, then before the Deadline: either (a) Part 23 application must be filed and served by the Defendant on the Claimant; or (b) a Consent Order agreed between the parties and filed on the Case Management System.
4. No order as to costs.
