CONSENT ORDER
UPON the Defendant’s Application No: CFI-062-2021/7 seeking the Claimants’ response to the Defendant’s Request for Further Information dated 5 September 2023 (the “RFI”) dated 25 April 2024 (the “Application”)
AND UPON the Defendant’s confirming it’s view that one hour is a realistic timeframe for the Application to be heard, and that the Defendant will limit its opening of the Application to no longer than 20-25 minutes
AND UPON the Claimants agreeing to the Defendant’s time estimate of one hour time on the basis of (i) the Defendant’s confirmation referred to above and (ii) the Application as it currently stands and without prejudice to the Claimants’ rights (and obligation under RDC 23.52) to increase the time estimate if necessary, including in respect of any further applications which may be made and which either the parties agree, or the Court directs, be heard alongside the Application
AND UPON the parties agreeing to the evidence timetable contained in this consent order in respect of the Application
AND UPON the parties agreeing the below directions by consent
IT IS HEREBY ORDERED BY CONSENT THAT:
1. The Claimants shall file and serve their evidence in answer to the Application by no later than 4pm on 23 May 2024.
2. The Defendant shall file and serve their evidence in reply (if any), by no later than 4pm 7 June 2024.
3. The costs of this Order shall be costs in the case.
4. Liberty to apply.
