UPON reviewing the Defendant’s application dated 3 February 2022 (i) to strike out parts of the Particulars of Claim under RDC 4.16(1), (ii) for immediate judgment under RDC 24.1 on certain claims brought by the Claimants, and (iii) to compel the Claimants to provide clarification or additional information under RDC 19.1 (the “IJ Application”)
AND UPON the Claimants’ Application by letter dated 24 February 2022 to stay the IJ Application until 2 May 2022 and for related directions (the “Letter Application”)
AND UPON reviewing the Defendant’s letter to the DIFC Courts’ Registry dated 28 February 2022
AND UPON reviewing the Claimants’ reply dated 2 March 2022
IT IS HEREBY ORDERED THAT:
1. The Letter Application be dismissed.
2. The time for the Claimants to file and serve their evidence in answer to the IJ Application is extended to 4pm on 24 March 2022.
3. The Claimants shall file and serve any draft amended Particulars of Claim by 4pm on 24 March 2022.
4. The time for the Defendant to file and serve its evidence in reply to the IJ application (if any) is extended to 4pm on 14 April 2022.
5. The Claimants shall pay the Defendant’s costs of the Letter Application to be subject to detailed assessment if not agreed.
