CONSENT ORDER
UPON the Defendant’s application dated 3 February 2022 (i) to strike out parts of the Particulars of Claim under RDC 4.16(1), (ii) for immediate judgment under RDC 24.1 on certain claims brought by the Claimants, and (iii) to compel the Claimants to provide clarification or additional information under RDC 19.1 (the “Strike Out Application”)
AND UPON the Claimants’ application dated 24 May 2022 for (i) permission to amend their Particulars of Claim under RDC 18.2(2) (the “Amendment Application”) (ii) an order that the Strike Out Application and the Amendment Application be listed at the same time (the “Listing Application”), and (iii) expedition of the Listing Application (the “Expedition Application”)
IT IS HEREBY ORDERED BY CONSENT THAT:
1. The Expedition Application and the Listing Application are dismissed with no order as to costs.
2. The Defendant shall file and serve its evidence in answer to the Amendment Application by 4pm on 6 July 2022.
3. The Claimants shall file and serve their evidence in reply (if any) by 4pm on 3 August 2022.
4. The Strike Out Application and the Amendment Application shall be listed on the first available date subject to the parties’ availability on or after 19 September 2022 with a time estimate of 2 days.
5. The parties shall provide the Registry with their dates of availability from 19 September 2022 to 7 October 2022 by 4pm on 8 June 2022.
6. Subject to paragraph 1, costs in the applications.
