IT IS HEREBY ORDERED BY CONSENT THAT:
Production of Documents
1. Standard production of documents to be made by each party by 4pm on Monday 21 February 2022.
2. Parties to file and serve any Request to Produce1 by 4pm on Monday 14 March 2022.
3. Where there are no objections to a particular Request contained in a Request to Produce, documents responsive to that request shall be produced within 21 days from the date of the Request to Produce, and in any event by 4pm on Monday 4 April 2022.
4. Objections to Requests to Produce (if any) shall be filed and served within 14 days thereafter and in any event by 4pm on Monday 18 April 2022.
5. If a party is not satisfied with the objections to any Requests to Produce2 it may apply to the Court for a Document Production Order using the Part 23 Form (the “Document Production Application”). The usual timelines under RDC 23, for progression of such an application, will apply.
6. Once the Document Production Application is fully progressed, the matter will be put before the Court for determination.
7. The parties shall comply with the terms of any Disclosure Order and file a Document Production Statement within 14 days from the date of the Disclosure Order.
Witness Statements
8. Signed statements of witnesses of fact, and hearsay notices where required, to be exchanged 6 weeks following the close of the disclosure stage, and in any event by 4pm on Friday 8 July 2022.
9. Any Witness Statement evidence in reply to be filed and served within 4 weeks thereafter and in any event by 4pm on Friday 5 August 2022.
10. Unless otherwise ordered, Witness Statements are to stand as evidence in chief of the witness at trial.
Pre-Trial Review
11. A pre-trial review is to be listed for Friday 12 August 2022.
Trial Bundles
12. Agreed trial bundles to be completed in accordance with Part 35 of the RDC and lodged by not later than 2 weeks before trial.
Reading List
13. A single reading list approved by all parties’ legal representatives together with an estimated timetable for trial are to be lodged with the Registry not later than 2 days before fixed trial date, together with an estimate of time required for reading.
Skeleton Argument, Opening Statements and Chronology
14. Skeleton Arguments and Written Opening Statements to be served on all other parties and lodged with the Court – two days before the start of trial for the Claimant and one day before the start of trial for the Defendant.
15. Parties to prepare a Chronology of significant events cross-referenced to significant documents, pleadings and witness statements to be agreed, insofar as possible, and to be filed 1 week before trial.
Trial
16. The trial of this matter is to take place not before Monday 31 October 2022 with an estimated duration of 4 days.
17. Costs in the Case.
