UPON the Case Management Order of H.E Justice Nassir Al Nasser dated 10 February 2022 (“CMO”)
AND UPON the Claimant’s Application No. CFI-064-2021/1, filed on 24 May 2022 for a Document Production Order (“DPO Application”)
AND UPON the parties having agreed, pursuant to RDC 23.42, to extend the timetable applicable to ordinary applications (as set out in RDC 23.41)
AND UPON the Pre-Trial Review (“PTR”) having been relisted for 12pm on Friday 19 August 2022
AND UPON the parties having agreed to the vary the terms of the CMO
AND UPON the Court reviewing the RDC and being satisfied that it may exercise its powers pursuant to RDC Parts 4 and 26
AND UPON the parties having agreed to the below directions by Consent
IT IS HEREBY AGREED BY CONSENT THAT:
1. The Defendant shall file and serve its answer to the DPO Application by 4pm on 13 June 2022.
2. The Claimant shall, if so advised, file and serve its reply to the Defendant’s answer to the DPO Application by no later 4pm on 27 June 2022.
3. Pursuant to RDC 23.69, the parties consent to the DPO Application being heard on the papers and without a hearing.
4. The deadline in paragraph 8 of the CMO for signed statements of witness of fact and hearsay notices is extended to 4pm on 26 August 2022.
