AND UPON the Defendant filing an Appeal Notice on 6 October 2023 seeking permission to appeal the Order (the “PTA Application”)
AND UPON the Defendant’s Application No. CFI-064-2022/4 filed on 13 December 2023 seeking an extension of time to file the skeleton argument for the PTA Application (the “Extension Application”)
AND UPON the Order with Reasons of Justice Wayne Martin issued on 16 January 2024 dismissing the Extension Application
AND UPON the Registry’s email of 13 August 2024 directing the Claimant to file its Particulars of Claim within 14 days
AND UPON the Claimant filing Particulars of Claim on 27 August 2024
AND UPON considering the Rules of the DIFC Courts
AND UPON the parties having agreed to the terms of this Order
IT IS HEREBY ORDERED BY CONSENT THAT:
1. The period for the Defendant to file and serve the Defence is extended until 4pm on 24 September 2024.
2. The costs shall be costs in the case.
