UPON the Defendants’ Application No. CFI-066-2020/4 dated 27 September 2020 (the “Application”) seeking a declaration that the DIFC Courts do not have jurisdiction
AND UPON hearing counsel for the Claimant and counsel for the Defendant at a hearing on 30 September 2020
UPON reviewing all documents recorded on the Courts’ file
IT IS HERBY ORDERED THAT:
1. The Application is dismissed. It is determined that the Court has jurisdiction to hear and determine these proceedings.
2. The deadline for the provision of information and affidavits relating to the Respondent’s assets shall be 4pm on Wednesday, 7 October 2020.
3. The claimant shall institute the substantive proceedings by 4pm on Sunday, 4 October 2020.
4. The Defendants shall pay the Claimant’s costs of this Application, within 14 days from the date of this Order, to be assessed by a Registrar on the standard basis if not agreed.
