UPON the Defendants' Application No. CFI-066-2020/4 dated 27 September 2020 seeking a declaration that the DIFC Courts do not have jurisdiction (the "Jurisdiction Application")
AND UPON the Jurisdiction Application being listed for a hearing before Justice Wayne Martin on 30 September 2020
AND UPON the Jurisdiction Application being dismissed and Justice Wayne Martin, by reason of his Order dated 1 October 2020, awarding the Claimant its costs of the Jurisdiction Application, to be assessed by the Registrar on the standard basis if not agreed
AND UPON the Claimant's Application dated 3 November 2020 seeking its costs on account in relation to the Jurisdiction Application pursuant to Practice Direction No. 5 of 2014 (the “Request”), the DIFC Court Registry's directions of 16 December 2020 and the Claimant’s filing of a Notice of Commencement of Assessment of Bill of Costs on 27 December 2020 (the "Costs Application")
AND UPON considering Practice Direction No. 5 of 2014 DIFC Courts’ Costs Regime
AND UPON taking into account all other relevant documents sitting on the case file
IT IS HEREBY ORDERED THAT:
1. The Request is granted.
2. The Defendants are ordered to pay a total USD 48,669.48 (the “Amount Payable”) into Court by 15 February 2021. This amount represents 50% of the total amount claimed by the Claimant in the Bill of Costs.
3. The Defendants must contact the Court before 7 February 2021 to obtain details for the Courts’ Escrow Account for transfer of the Amount Payable.
