CONSENT ORDER
UPON the Case Management Order of H.E. Justice Nassir Al Nasser dated 13 December 2023 (the “CMO”), and in particular paragraph 2 of the CMO which directs that the parties shall file and serve Requests to Produce by 4pm GST 29 January 2024
AND UPON the Consent Orders issued on 5, 7,12, 19 and 20 February 2024, agreeing to further vary the CMO
AND UPON the agreement of the parties that the terms of the CMO shall be further varied on the terms set out below
IT IS HEREBY ORDERED BY CONSENT THAT:
1. Paragraph 2 of the CMO shall be varied as follows:
“The parties shall file and serve a Request to Produce, if any, by no later than 4pm GST 4 March 2024.”
2. Paragraph 3 of the CMO shall be varied as follows:
“Where there are no objections to a particular Request contained in a Request to Produce, documents responsive to that request shall be produced within 14 days from the date of the Request to Produce (i.e. by 4pm GST 18 March 2024).”
3. Paragraph 4 of the CMO shall be varied as follows:
“Objections to Requests to Produce, if any, may be filed and served by no later than 4pm GST 25 March 2024.”
4. Paragraph 5 of the CMO shall be varied as follows:
“If a party is not satisfied with the objections to any Requests to Produce it may apply by no later than 4pm GST 1 April 2024 to the Court for a Document Production Order using the Part 23 Form (the “Document Production Application”). The usual timelines under RDC 23, for progression of such an application, will apply.”
5. Costs shall be costs in the case.
