CONSENT ORDER
UPON the Parties having agreed, pursuant to a Settlement Agreement dated 16 January 2024, to settle and discontinue the Claimant’s Claim and the Defendant’s Counterclaim in the above proceedings
AND UPON reviewing the provisions of Part 34 RDC
IT IS HEREBY ORDERED BY CONSENT THAT:
1. The Claimant shall file a Notice of Discontinuance of its Claim within 2 working days of the date of this Order (the “Claimant’s Discontinuance”)
2. The Defendant shall file a Notice of Discontinuance of its Counterclaim within 2 working days of the date of this Order (the “Defendant’s Discontinuance”)
3. Upon the Claimant’s Discontinuance and the Defendant’s Discontinuance being filed, the proceedings under CFI-066-2022 shall be deemed discontinued and terminated.
4. The provisions of RDC 34.15 shall not apply and each party shall bear its own costs.
5. There shall be no order as to costs.
