AMENDED CONSENT ORDER
UPON the parties having reached agreement with respect to the filing of the Defendant’s Amended Statement of Defence and Counterclaim
AND UPON the Claimant having agreed that it has no objection to the Defendant’s filing of its Amended Statement of Defence and Counterclaim provided that an agreed amount of AED 37,500 (excluding VAT) is paid by the Defendant, to the Claimant, representing its costs of and arising from the Amended Statement of Defence and Counterclaim pursuant to RDC 18.27
AND UPON the Defendant’s counsel undertaking to effect payment of the sum of AED 37,500 (excluding VAT) to the Claimant’s Counsel within 7 days of filing the Amended Statement of Defence and Counterclaim (i.e. no later than 22 April 2024)
AND UPON the parties having reached an agreement to vary the necessary dates set out in the case management order of 18 January 2024
IT IS ORDERED BY CONSENT THAT:
1. The Defendant shall file and serve its Amended Defence and Counterclaim, in the form provided to the Claimant’s Counsel in its email dated 20 March 2024, by no later than Monday, 17 April 2024.
2. The Claimant shall have until 23 April 2024 to file and serve its Amended Reply and Defence to Counterclaim.
3. The Defendant shall have until 1 May 2024 to file and serve its Reply to the Defence to Counterclaim.
4. The Parties shall file and serve a Request to Produce, if any, by no later than 4pm on 3 May 2024.
5. Where there are no objections to a particular request contained in a Request to Produce, documents responsive to that request shall be produced by no later than 4pm on 14 May 2024.
6. Objections to Requests to Produce, if any, must be filed and served by 4pm on 14 May 2024.
7. If a party is not satisfied with the objections to any Request to Produce it may apply to the Court for a Document Production Order using the Part 23 Form (the “Document Production Application”). If the party makes such application, it must do so by no later than 4pm on 17 May 2024. The usual timelines under RDC 23, for progression of the Document Production Application will be reduced to 10 days to file evidence in answer and 7 days to file evidence in reply. Upon making such application, the dates set out below in Orders 13-23 shall be stayed and when issuing the Document Production Orders, the court shall set new dates (where necessary) for Orders 13-23 of these Orders, with the endeavour of keeping the parties on track for the date of the trial, as set out in Order 24.
8. The Defendant shall pay the Claimant’s costs arising from this consent order and the Amended Statement of Defence and Counterclaim pursuant to RDC 18.27, in the fixed sum of AED 37,500, and such sum must be paid to the Claimant’s counsel by 22 April 2024.
