UPON further consideration of the Claimant’s Application Notice dated 7 November 2018 seeking an interim injunction (“the Claimant’s Application”)
AND UPON the Claimant giving its express confirmation that it will not take any of the steps or actions set out in paragraph 1 of the draft order served with the Claimant’s Application
AND UPON the Defendant stipulating unequivocally that it consents herein, strictly without prejudice their right to dispute the jurisdiction of the Dubai International Financial Centre Court (DIFC-LCIA), and further, consent herein does not constitute any acceptance of the validity of the arbitration agreement.
IT IS HEREBY ORDERED THAT:
1. The Claimant’s Application is adjourned generally with liberty to apply.
2. Costs in the case.
