CONSENT ORDER
UPON the Defendant’s application by notice dated 19 February 2019 that the Court does not have jurisdiction and the Claimant’s application by notice dated 20 February 2019 for inter alia the Defendant’s acknowledgement of service to be set aside and for default judgment to be entered (the ‘Applications’)
AND UPON the Claimant having notified the Registry that the parties seek an adjournment for the purposes of settlement negotiations and/or alternative dispute resolution
BY CONSENT IT IS ORDERED THAT:
1.The hearing on 17th November 2019 be vacated.
2. The hearing of the Applications be adjourned to the first available date after 1 December 2019 with a time estimate of one day, for the purpose of enabling the parties to engage in settlement negotiations and/or alternative dispute resolution.
3. By no later than 4.00pm on 14th November 2019 the parties’ representatives shall provide the Registrar with dates to avoid for the purpose of the Registrar listing the adjourned hearing of the Applications. If a party fails to provide dates to avoid by that date, the Registrar shall be entitled to list the hearing of the Applications without reference to the availability of that party’s representatives.
4. The parties shall inform the Court immediately should a settlement agreement be entered into, whether or not it is possible immediately to file a Consent Order giving effect to the settlement.
5. Costs in the Applications.
