UPON the Defendant having filed a Notice of Commencement of Assessment on 11 February 2022 (the “NOC”)
AND UPON the Defendant’s request for a Default Costs Certificate made on 23 March 2022 (the “Request”) pursuant to r. 40.17 of the Rules of the DIFC Court (the “RDC”)
AND UPON the Claimant’s failure to file its Points of Dispute, pursuant to RDC r. 40.15, within 21 days from the date the Defendant served the Claimant with its NOC
AND UPON reviewing all other relevant case documents filed in this matter
IT IS HEREBY ORDERED THAT:
1. The Request is granted.
2. The Claimant is ordered to pay the Defendant a total of USD 113,706 (the “Amount”) within 21 days from the date of this Order.
3. In the event the Claimant does not pay the Amount within 21 days from the date of this Order, interest, pursuant to Practice Direction No. 4 of 2017 (Interest on Judgments) will accrue on the Amount from 20 April 2022 until the date of full payment.
