CONSENT ORDER
UPON reviewing the Court file
AND UPON reading the letter of the parties to the DIFC Court dated 9 October 2019
AND UPON reviewing the Case Plan
AND UPON reviewing the Rules of the DIFC Courts (the “RDC”)
IT IS HEREBY ORDERED BY CONSENT THAT:
Amendment to Timetable
1.The Case Management Conference (the "CMC") scheduled to be held before the Court and Judicial Officer Nassir Al Nasser at 10AM on 17 October 2019 be postponed by at least two months from the date of the CMC and be re-convened at a date thereafter as proposed by the Court.
2. The Claimant shall have an opportunity to file and serve a draft Amended Particulars of Claim on or before Thursday 7 November 2019 such amendment will be subject to agreement in writing between the parties or permission by the court in accordance with DIFC Court Rule 18.2 with appropriate consequential directions.
3. The Defendant shall have an opportunity to file and serve an Amended Defence on or before Thursday 5 December 2019. If and to the extent such amendment relates to matters other than amendments consequential to any amendments to the Particulars of Claim such amendments will subject to agreement permission by the court in accordance with DIFC Court Rule 18.2).
4. The timetable set out by the DIFC Court in the Case Plan shall be amended by the DIFC Court as appropriate following the amendments set out at paragraphs 1, 2 and 3 of this Consent Order above.
Costs
5. If and to the extent the Claimant is permitted to amend the Particulars of Claim it shall bear the reasonable costs incurred by the Defendant in preparation of its Amended Defence in respect of the amendments made by the Claimant.
