UPON the Claimant’s Part 8 claim issued on 20 October 2020 seeking a declaration from the Court that the DIFC Court has exclusive jurisdiction over the matters brought before the Abu Dhabi Courts by the First Defendant under Case Nos. 3569/2020 and 3596/2020 which are appeals in respect of Case No. 1486/2019 (the “First Declaration Sought”) and the dispute between the parties as particularised in the Particulars of Claim in this action (the “Second Declaration Sought”)
AND UPON the order of the Court dated 30 November 2020 which declined making the First Declaration Sought and made the Second Declaration Sought, explained in reasons dated 10 December 2020 (the “Order”)
AND UPON the application of the Claimant dated 21 October 2020 seeking permission to appeal the Order (the “Application”)
IT IS HEREBY ORDERED THAT:
1. The Application is granted on the basis that the requirement of RDC r. 44.19(2) has been met i.e. there is some compelling reason why the appeal should be heard.
