CONSENT ORDER
UPON the Agreed Case Management Order dated 21 September 2020 setting out a timetable in respect of this matter (the “ACM Order”)
AND UPON the Consent Orders dated 6 December 2020, 15 December 2020, 11 January 2021, 28 January 2021, 11 February 2021 and 23 February 2021 (the “February Consent Order”) which amended certain Consent Orders and the ACM Order
AND UPON the directions given by the DIFC Courts’ Registry by way of email dated 20 April 2021
AND UPON THE AGREEMENT of the Claimants and the Defendant
BY CONSENT IT IS ORDERED THAT:
1. Paragraph 1 of the February Consent Order is amended such that the time by which any application by any Party for a Document Production Order shall be extended to 4pm on 29 June 2021.
2. Paragraph 2 of the February Consent Order is amended such that the time by which the parties exchange signed statements of witnesses of fact, and hearsay notices where required, shall be extended to 3pm on 9 September 2021.
3. Paragraph 3 of the February Consent Order is amended such that the time by which the parties file and serve any Witness Statement evidence in reply shall be extended to 3pm on 3 October 2021.
4. Agreed trial bundles shall be filed and served by 3pm on 11 October 2021.
5. An agreed eBundle shall be lodged with the Registry by no later than 3pm on 25 October 2021.
6. Paragraph 4 of the February Consent Order is amended such that the Progress Monitoring Date shall be listed at 1pm on 28 October 2021.
7. Paragraph 5 of the February Consent Order is amended such that the time by which the parties file and serve a Progress Monitoring Information Sheet shall be extended to 3pm on 25 October 2021.
8. Paragraph 6 of the February Consent Order is amended such that a pre-trial review shall be listed at 10am on 1 November 2021.
9. The parties shall filed and serve their skeleton arguments by 3pm on 5 December 2021.
10. Paragraph 7 of the February Consent Order is amended such that the trial of this matter shall be listed for a duration of 3-5 days, commencing 12 December 2021.
11. The costs of this Order shall be costs in the case.
