AND UPON the Defendant’s Application No. CFI-095-2024/3 dated 17 February 2025 seeking the Court’s permission for Mr Vadim Misevich to be joined as a party to these proceedings (the “Application”)
AND UPON the hearing Counsel for the Claimant and Counsel for the Defendant at the Case Management Conference held on 18 February 2025 before H.E. Justice Andrew Moran
AND UPON the Claimant filing Mr Vadim Misevich’s signed consent to be added as a claimant in these proceedings dated 19 February 2025
IT IS HEREBY ORDERED THAT:
1. Mr Vadim Misevich is hereby joined as the Second Claimant in these proceedings.
2. The Claimants shall by no later than 4pm (GST) on 7 March 2025, file and serve an amended Claim Form and Particulars of Claim.
3. The Defendant shall by no later than 4pm (GST) on 28 March 2025, file and serve a Defence and Counterclaim.
4. The Claimants shall by no later than 4pm (GST) on 11 April 2025, file and serve a Reply and Defence to Counterclaim.
5. The Claimants shall by no later than 4pm (GST) on 25 April 2025, file and serve a Reply to Defence to Counterclaim.
6. The Parties shall, after 2 May 2025, confer and endeavor to agree a timetable towards a speedy trial of the issues.
7. A further CMC to give directions to trial shall be listed for Monday, 12 May 2025 before H.E. Justice Andrew Moran, with a time estimate of 2.5 hours. The parties shall endeavour to reach agreement on the said timetable prior to the hearing.
8. Costs, including of the Application, shall be costs in the case.

SCHEDULE OF REASONS
1. I am persuaded for all of the reasons advanced by Mr. Watson, that the fairest and most efficient mode of proceeding towards a speedy or expedited trial, is to adopt the course proposed by him at paragraph four of his skeleton argument, and I will now issue directions to that effect.
2. I do not propose to give any further reasons. The issues have plainly been well-argued before me, and they can be transcribed. In fact, it would be useful to order a transcript of this short hearing so that the observations I have made concerning the need for a speedy trial (which remain) are preserved and available for everybody.
3. A second case management conference will be fixed on Monday, 12 May 2025.
4. I will include a direction that the Parties endeavor after 2 May 2025, to agree a timetable towards a speedy trial of the issues that I have identified, or indeed as I have mentioned in my order, it is open to the parties to seek a revision of those issues but the object will be to determine the core issues in this dispute as speedily as possible to protect the business and the interests of whichever party is entitled to the beneficial ownership of the shares in these businesses. So that is my objective.
5. I will order that the costs of this hearing and the application be costs in the case.
