CONSENT ORDER
UPON the Defendants’ Application No. CFI-099-2021/1 dated 18 January 2022 contesting the DIFC Court’s jurisdiction
AND UPON the Order with Reasons of Justice Wayne Martin dated 14 June 2022 (the “June Order”)
AND UPON the Court having ordered the Claimant to pay the Defendants’ costs of the proceedings to be assessed by the Registrar if not agreed
AND UPON the Defendants having filed a Notice of Commencement of Assessment of a Bill of Costs (the “Costs Assessment”)
AND UPON the parties having agreed the said costs and a payment schedule, as recorded in this Consent Order
ITS HEREBY ORDERED BY CONSENT THAT:
1. The costs due to the Defendants under paragraph 6 of the June Order shall be fixed at USD 150,000.
2. The Claimant shall pay the said USD150,000 to the Defendants in the following instalments:
a. USD 50,000 by 14 October 2022;
b. USD 50,000 by 14 November 2022; and
c. USD 50,000 by 14 December 2022.
3. Pursuant to Practice Direction No. 4 of 2017, if the Claimant fails to pay any sum due under paragraph 2 hereof by the relevant due date, simple interest at a rate of 9% p.a. shall accrue on any unpaid sum until payment.
4. There shall be no further order on the Costs Assessment.
