DEFAULT JUDGMENT OF H.E. JUSTICE MAHA AL MHEIRI
UPON the request made by the Claimants on 28 June 2022 for a Default Judgment against the Defendants in accordance with Part 13 (the “Request”) of the Rules of the DIFC Courts (“RDC”), it is found as follows:
1. The Request is not one prohibited under RDC r.13.3 (1) or (2).
2. The Request is one permitted by RDC r.13.4 on the basis that the Defendants have failed to file an Acknowledgment of Service or a Defence to the claim (or any part of the claim), with the DIFC Courts, and the relevant time for so doing has expired.
3. The Claimants filed a Certificate of Service in respect of service on the Defendants under RDC 9.43 on 17 May 2022.
4. The Claimants have followed the required procedure for obtaining Default Judgment under RDC rr.13.7 and 13.8.
5. The Request includes a request for interest pursuant to RDC r.13.14 and the Claim Form sets out the calculation of interest in the claim.
ACCORDINGLY, IT IS HEREBY ORDERED THAT:
6. The Request is granted.
7. The Defendants shall jointly and severally pay to the First Claimant within 14 days from the date of this Order, the judgment sum of US$103,286.67 (the “C1 Principal Judgment Sum”).
8. The Defendants shall also pay interest on the C1 Principal Judgment Sum to the First Claimant from 1 February 2019 at the rate of 12% annually, until the date of full payment.
9. The Defendants shall jointly and severally pay to the Second Claimant within 14 days from the date of this Order, the judgment sum of US$103,286.67 (the “C2 Principal Judgment Sum”).
10. The Defendants shall also pay interest on the C2 Principal Judgment Sum to the Second Claimant from 1 February 2019 at the rate of 12% annually, until the date of full payment.
11. The Defendants shall pay the Claimant’s costs of these proceedings, comprising of the Claimant’s legal costs of the Request, to date, as well as those amounts, borne by the Claimant, for payment of the Court filing fee in this claim.
