UPON the application filed by the Judgment Creditor to issue an order to instruct the third party which holds money to the credit of the judgment debtor to freeze the amount of AED 71,187.
AND UPON reading the supporting documents submitted with the application.
IT IS ORDERED THAT:
1. Abu Dhabi Commercial Bank ("ADCB") Ittihad Branch located at Sheikh Zayed Road, Emmar Business Park, Building Number 2, P.O. Box 37363, Dubai - UAE, outside the DIFC, freeze the amount of AED 71,187 under the account name of Orion Holding Overseas Limited and account number 40647502001.
2. ADCB disclose to the DIFC Courts and the Judgment Creditor within 7 days of being served with this order, in respect of each account held by the Judgment Debtor —
a. the number of the Judgment Debtor's account;
b. whether the account is in credit; and
c. if the account is in credit —
i. whether the balance of the account is sufficient to cover the amount specified in this order;
ii. the amount of the balance at the date it was served with this order, if it is less than the amount specified in this order; and
iii. whether ADCB asserts any right to the money in the account, whether pursuant to a right of set-off or otherwise, and if so giving details of the grounds for that assertion.
3. The return date for the hearing of this application on notice to the Judgment Debtor shall be Thursday, 3 September 2009 at 11:00am.
4. The Judgment Creditor shall have leave to serve this Order out of the jurisdiction of the DIFC Courts.
