UPON the Amended Case Management Order of Justice Sir Richard Field dated 22 June 2021 (the “CMC Order”)
AND UPON the Second Defendant’s Application Notice No. TCD-001-2020/8 dated 24 August 2021 (the “Application) requesting a 3 day extension to paragraph 6 of the CMC Order to file for a document production application and relief from any sanctions
AND UPON the Claimant’s reply to the Second Defendant’s Application filed on 26 August 2021
IT IS HEREBY ORDERED THAT:
1. The Request for relief from sanctions, is denied.
2. The Court shall accept the document production application, which must be filed no later than 3 days after the original date set out at paragraph 6 of the CMC Order, but shall apply the applicable penalties set out at the section entitled “Article III, Penalties (A)” of the DIFC Courts Fee Schedule.
3. The Second Defendant shall pay the late filing fee associated with the late filing in the amount of USD 600 or the document production application will be deemed unfiled.
4. The Second Defendant shall pay the Claimant’s costs of this Application, to be immediately assessed by the Registrar, if not agreed.
5. Liberty to apply.
