AND UPON hearing Counsel for the Claimant and the Defendant at the Pre-Trial Review hearing held before Sir Justice Richard Fields on Thursday, 8 April 2021 and Monday, 12 April 2021
IT IS HEREBY ORDERED THAT:
Respondent Application to Serve Witness Evidence
1. The Respondent's application dated Wednesday, 17 February 2021 for permission to serve late lay witness evidence of Mr Madahaven is refused.
2. The Respondent's application dated Wednesday, 17 February 2021 for permission to serve late expert witness evidence of Dr Ahmed Ghali is refused.
Trial Bundles (RDC Part 35)
3. Agreed trial bundles shall be filed and served by 4pm on Sunday, 2 May 2021.
Reading List and Trial Timetable (RDC Part 35)
4. An agreed reading list for trial along with an estimate of the time required for reading and an estimated timetable for trial shall be filed with the Court by the Claimant by 4pm on Thursday, 6 May 2021.
Skeleton Argument and Chronology (RDC Part 35)
5. Skeleton Arguments and Written Opening Statement shall be filed and served by 4pm on Monday, 10 May 2021 and for the Defendant by 4pm on Tuesday, 11 May 2021.
6. The parties shall prepare an agreed Chronology of significant events crossreferenced to significant documents, pleadings and witness statements which shall be filed with the Court by the Claimant by 4pm on Thursday, 13 May 2021. In the event that there are areas of disagreement, the Chronology shall include an agreed Chronology and a Chronology of events which are disputed, with the parties' respective positions outlined therein.
Trial (RDC Part 35)
7. The trial of this matter shall be listed in the Technology Construction Division at 12pm on Monday, 17 May 2021 with an estimated duration of two days.
8. No order as to costs.
