AND UPON counsel for the Defendant filing application notice TCD-003-2019/2 on 20 February 2020 applying for an order that the Default Judgment be set aside (the “First Application”)
AND UPON reviewing application notice TCD-003-2019/3 filed on 14 April 2020 filed by counsel for the Claimant seeking an order that the Defendant pay the Claimant’s specific costs of the Default Judgment and of the First Application (the “Second Application”)
AND UPON reviewing the Rules of the DIFC Courts (“RDC”)
IT IS HEREBY ORDERED THAT:
1. The Default Judgment is set aside.
2. The Defendant shall pay the Claimant’s costs of and occasioned by Default Judgment and the First Application. Such costs are to be assessed, by a Registrar, if not agreed.
