UPON the parties attending a hearing on 24 August 2020 (the “Hearing”)
UPON the Court at the Hearing directing the parties to file pleadings on the Preliminary Issue
UPON the Defendant filing its pleading on the Preliminary Issue on 7 September 2020.
UPON the Claimant filing its pleading on the Preliminary Issue on 21 September 2020
UPON the Claimant introducing new evidence on the Preliminary Issue on 27 September 2020 by way of e-mail correspondence (the “New Evidence”).
AND UPON the Claimant and the Defendant having agreed to the terms set forth in this Order
IT IS HEREBY ORDERED BY CONSENT THAT:
1. The Claimant shall provide its witness statement introducing the New Evidence by 4 pm on Wednesday, 30 September 2020.
2. The Defendant shall file its pleading in reply on the Preliminary Issue by 4 pm on Thursday, 1 October 2020.
3. The Parties shall mutually exchange skeleton arguments by 4pm on Thursday, 8 October 2020.
4. The Preliminary Issue shall be listed for hearing on the first open date after 15 October 2020.
