PRACTICAL GUIDANCE NOTE No. 2 of 2021
INDEX OF DOCUMENTS AT THE TIME OF FILING
Citation
This Practical Guidance Note will come into effect from 29 June 2021. It may be cited as Practical Guidance Note 2 of 2021 – Index of Documents at the time of Filing and may be abbreviated to PGN 2/2021.
1. Scope
1.1 This Practical Guidance Note applies to all Civil and Commercial Proceedings.
1.2 This Practical Guidance Note contains general provisions about:
(a) indexing documents used in court proceedings; and
(b) the obligations of the parties in relation to filing and serving documents.
2. Indexing of documents
2.1. Where any Rule, Practice Direction or Practical Guidance Note requires filing or service of any document for the purpose of proceedings, the party filing a document shall also file a list of the document(s) being filed (the “Index”).
3. Contents of the Index
3.1. The Index shall conform to the requisites of RDC Rule 6.6 and in addition it shall:
(a) be the first page of the document(s) being filed;
(b) include the date of the document(s);
(c) include a short title of the document(s), which shall be as concise as possible;
(d) adequately and clearly describe each document being filed;
(e) adequately and clearly define the nature of each document being filed;
(f) consecutively include the page number of each document being filed and the total number of pages of the document(s);
(g) include the name(s) and address of the Party or individual or the Legal Representative’s Office filing each document; and
(h) include the date in which the document(s) are being filed.
4. Miscellaneous
4.1. The provisions for filing and serving of the documents is subject to RDC Rule 6 which shall also apply to Part 2 of this Practical Guidance Note.
4.2. Any Index placed before the Court in Civil or Commercial Proceedings must be in the English language.
4.3. Nothing in this Practical Guidance Note shall require a court officer to accept a document which is illegible, has not been duly authorized, or is unsatisfactory for some other similar reason
