The DIFC Courts welcomes views and comments on the two new Parts of the DIFC Courts Rules Part 43 (Arbitration) and Part 53 Small Claims Tribunal (SCT) in accordance with Article 31 of the DIFC Law No. 10 of 2004 (Court Law) and invites interested persons to make representations with respect to these Rules by 18 January 2009. The public consultation will run for a period of 30 days (19 December 08 – 18 January 09).
The Rules provide procedural rules in relation to all claims brought up before the Small Claims Tribunal, Court of First Instance and Court of Appeal. Part 43 of the Rules will set out the procedures relating to Arbitration claims arising from Arbitrations from the DIFC LCIA Arbitration centre. This will involve supervision, interim applications as well as enforcement and ratification of arbitration awards. Part 53 of the Rules will deal with the process of opening claims under the unique fast track tribunal for all cases up to AED 100,000 from commencement to resolution either by way of settlement or judgement.
The DIFC Courts values all comments received on draft rules and will endeavour to take into account all comments received when issuing the rules.
