February 25, 2021 CONSULTATIONS
1. This is a public consultation on a proposed rule amendment to Part 53 of the Rules of the DIFC Courts (“RDC”) relating to the Small Claims Tribunal (the “SCT”). The DIFC Courts’ Registrar seeks public comments on the proposed amendments.
2. Proposed key changes to the new (draft) Part 53 Rules include:
(a) the introduction of SCT specific appeal rules;
(b) the provision for applications for permission to appeal to be put before the Court of First Instance (rather than the SCT) for determination;
(c) introducing reduced timeframes for permission to appeal applications for the purposes of continuing to embrace time efficiency, even at the appeal stage;
(d) the provision for legal (and non legal) representation of parties at the consultation and hearing; and
(e) introducing timeframes for applications brought in claims filed before the SCT.
