December 17, 2014 CONSULTATIONS
Today the DIFC Courts have released 2 Practice Directions for a final period of consultation within the legal community on Referral of DIFC Courts Judgments to Arbitration. The earlier draft which was titled “Practice Direction X of 2014” has now been sub-divided into 2 separate Practice Directions: namely “Practice Direction Y of 2015” and “Practice Direction Z of 2015” – to highlight that this mechansim does not only apply to elective opt-in jurisdiction cases, but is also open to parties who are already under the jurisdiction of the DIFC Courts.
The Chief Justice of the DIFC Courts, Michael Hwang SC, has also released his Lecture Notes from the seminar in which he discussed the initiative in November 2014, in order to provide further guidance as to the impetus and rationale behind the proposal.
