Court Ordered Alternative Dispute Resolution

This Registrar’s Direction will come into effect on the date of signature. It may be cited as Registrar’s Direction 1 of 2018 — Court Ordered Alternative Dispute Resolution and may be abbreviated to RD 1/2018.
Court Ordered Alternative Dispute Resolution under Part 27 of the Rules of the DIFC Courts (RDC)
1.The Registrar draws parties’ attention to Part 27 of the RDC which enables the judge to invite parties to consider whether their dispute, or particular issues in it, could be resolved through alternative dispute resolution. This includes but is not confined to mediation and conciliation (see RDC Rules 27.1, 27.3 and 27.7 in particular).
2. In this connection, Part 27 of the RDC empowers the judge to make an alternative dispute resolution order in the terms set out in the Schedule to Part 27 (see RDC Rule 27.8).
3. Whilst the making of such an order is a matter for the discretion of the judge, the normal practice of the Court will be to make such an order at the Case Management Conference unless the parties can provide compelling reasons why such an order should not be made.
